Gone are the days when you have to go some library and take from a shelf the latest edition of Supreme Court Reports Annotated (SCRA) to find jurisprudence on an issue which you cannot even describe as recent.

Any lawyer or law student nowadays, who is familiar with the Internet, would know that the Supreme Court itself has been posting their recent decisions and resolutions on their official website.

This allows any tech-savvy individual to have access to the full text of the most recent decisions of the highest court of the land. In addition to that, technology is now available for anyone to search for words and phrases found in these decisions and resolutions and determine what are relevant to a case at hand.

Taking advantage of all these and with the goal of being able to help all lawyers and law students alike, LawMonitor.Net is launching its Recent Philippine Supreme Court Decisions and Resolutions Search Tool which you will find on our right side bar.

The tool will help you search for words and phrases found on the official text of all Supreme Court Decisions and Resolutions from 1996 to as recent as 2010 posted at the official website of the highest court of the land.

SC issues rule on mandatory legal aid service for lawyers

The members of the Supreme Court again demonstrated their concern for the poor when it approved BM 2012 entitled "Proposed Rule on Mandatory Legal Aid Service" requiring practicing lawyers to render at least 60 hours of mandatory free legal service for each year. The move is aimed at improving access to justice for the less privileged of our society.

Section 2 of the Rule specifically states that "This Rule seeks to enhance the duty of lawyers to society as agents of social change and to the courts as officers thereof by helping improve access to justice by the less privileged members of society and expedite the resolution of cases involving them. Mandatory free legal service by members of the bar and their active support thereof will aid the efficient and effective administration of justice especially in cases involving indigent and pauper litigants."

Supreme Court issues rules on small claims cases

With not much attention from the public, the Supreme Court approved last September 9 a new Rules of Procedure for Small Claims Cases (A.M. No. 08-8-7-SC) which took effect last October 1.

This Rule will govern the procedure in actions before the Metropolitan Trial Courts, Municipal Trial Courts in Cities, Municipal Trial Courts and Municipal Circuit Trial Courts for payment of money where the value of the claim does not exceed One Hundred Thousand Pesos (P100,000.00) exclusive of interest and costs.

The Rules introduced a lot of innovations one of which is the banning of lawyers in such proceedings. According to it, no attorney will be allowed to appear in behalf of or represent a party at the hearing, unless the attorney is the plaintiff or defendant.

If the court determines that a party cannot properly present his/her claim or defense and needs assistance, the court may, in its discretion, allow another individual to assist that party upon the latter’s consent, provided the said individual is not an attorney.

Chief Justice Puno for President

The Inquirer ran an interesting story today. They reported that, Chief Justice Puno sees himself as the president - not of the country - but of his household when he steps down from the Supreme Court in 2010.

It seems some groups are wooing Chief Justice Renato Puno to run for president in 2010 which is also the year when he is scheduled to retire. But the Chief Justice is not keen on the idea and said he would prefer to spend more time with his grandchildren.

Nevertheless, I bet a lot of 2010 presidentiables are worried of the prospect of the Chief Justice joining the election fray. It should make them think a bit on whether they really deserve to be the president of this country.

2008 Bar Examination Questions

The legal yardstick in determining whether usage has become customary international law is expressed in the maxim opinio juris sive necessitates or opinio juris for short. What does the maxim mean?

That is the first question in Political Law in the recently held bar examinations. Unlike in the past, the Supreme Court has chosen to publish the questions themselves, on its own website.

The move is a welcome development for law students in the provinces who can only wonder what the questions were in the different bar subjects.

Lawyer gets free haircut

A barber gave a haircut to a priest one day. The priest tried to pay for the haircut, but the barber refused, saying, "you do God's work." The next morning the barber found a dozen Bibles at the door to his shop.

A policeman came to the barber for a haircut, and again the barber refused to pay, saying, "you protect the public." The next morning the barber found a dozen doughnuts at the door to his shop.

A lawyer came to the barber for a haircut, and again the barber refused payment, saying, "you serve the justice system." The next morning the barber found a dozen lawyers waiting for a free haircut.
